These Terms and Conditions ("Agreement") govern the use of the website, services, and offerings provided by Niagara Area Historical Society Inc. ("NAHS," "we," "us," or "our"). By accessing this website, making a donation, purchasing merchandise, or becoming a member, the user ("you," "your," or "Member") agrees to be bound by the terms set forth herein.
1. ORGANIZATION INFORMATION
Niagara Area Historical Society Inc. is a nonprofit entity organized under Section 501(c)(3) of the Internal Revenue Code. The purpose of NAHS is to preserve and promote the historical significance of Niagara, Wisconsin, and the surrounding region through research, exhibits, education, and community engagement.
2. ACCEPTABLE USE OF WEBSITE
The NAHS website provides access to historical content, research materials, and information about membership, donations, and events. Users may browse content, submit comments where applicable, make donations, purchase merchandise, sign up for memberships, and submit inquiries via the contact form.
The unauthorized downloading, reproduction, redistribution, or republication of any text, images, or research materials on this website is strictly prohibited without prior written consent from NAHS. Users are prohibited from engaging in conduct that disrupts the intended functionality of the website or posting offensive, defamatory, or inappropriate content in any interactive areas of the site. NAHS reserves the right to remove any content deemed inappropriate and to restrict access to users who violate these terms.
3. MEMBERSHIP TERMS
Annual memberships automatically renew unless canceled by the Member prior to the renewal date. Membership fees are non-refundable. A Lifetime Membership is available for a one-time payment of $200 and is also non-refundable. Membership provides reduced admission to paid NAHS events. Lifetime Members receive additional benefits, including research assistance from NAHS staff.
4. DONATIONS
All donations to NAHS are final and non-refundable. As a registered 501(c)(3) nonprofit organization, donations to NAHS may be tax-deductible; however, NAHS makes no representations regarding the deductibility of contributions, and donors should consult a tax professional regarding individual tax implications.
5. ONLINE STORE AND MERCHANDISE POLICY
Merchandise purchased from NAHS may be returned for a full refund, excluding shipping costs. The customer is responsible for all return shipping fees. Orders will be processed and shipped within three (3) business days from the date of purchase. NAHS reserves the right to deny refunds if the returned item is damaged or not in its original condition.
6. RESEARCH ACCESS AND CONTENT USAGE
Both Members and non-members may access NAHS archival materials during open hours. Research materials may be utilized in publications and other works, provided that NAHS is properly cited as the source. NAHS does not guarantee the accuracy, completeness, or reliability of any historical materials provided. Users assume all responsibility for verifying sources and information obtained through NAHS archives.
7. LIMITATION OF LIABILITY
NAHS makes no warranties, express or implied, regarding the accuracy or completeness of historical research materials. NAHS shall not be held liable for any errors, omissions, or inaccuracies in the content provided, nor for any damages arising from the use or reliance upon such information. Users accessing research materials, historical content, or services do so at their own risk. NAHS shall not be responsible for any financial losses, indirect or consequential damages, or any claims resulting from reliance on materials obtained from its archives.
8. MODIFICATIONS TO TERMS AND CONDITIONS
NAHS reserves the right to amend, modify, or update these Terms and Conditions at any time without prior notice. Any changes shall take effect immediately upon posting to this website. Continued use of the website, services, or membership following the implementation of revised terms constitutes acceptance of such changes.
9. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the State of Wisconsin. Any disputes arising under this Agreement shall be resolved in the courts located in Marinette County, Wisconsin.
